LOHT SMS Privacy Policy and Related Terms & Conditions

The Law Office of Holly Terrell, PLLC (“LOHT”) is committed to protecting your privacy. This Privacy Policy and Related Terms & Conditions (“Policy”) governs how LOHT treats Personal Information collected/received from you in connection with your use of the SMS Text-Message Based Service (“Service”) made available through a 3rd party service provider.
 
These terms constitute a legal agreement; please read them carefully. By using the Service, you agree to the terms of this Policy. LOHT reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to you. This Policy and any changes thereto are effective when posted. Your continued use of the Service constitutes full acceptance of all changes.
 
Personal Information
Through use of the Service by you, LOHT will receive Personal Information. “Personal Information” is information that individually identifies you. This includes your mobile phone number and any information you include in messages you send through the Service. LOHT uses Personal Information to (a) provide/improve the Service, (b) process/respond to inquiries, and (c) provide/request important information. Each message you send through the Service is retained on servers owned by 3rd parties.
 
Disclosure of Personal Information
We will not rent or sell Personal Information to other companies or individuals. We may use or disclose such information in any of the following limited circumstances:

• We have your consent.

• To enforce this Policy or another contract between you and LOHT.

• Provision of Personal Information to trusted 3rd parties for the purpose of processing such information on our behalf. Provision will be subject to agreements that such 3rd parties will process the information in accordance with LOHT’s instructions and in compliance with appropriate confidentiality and security measures. To the extent any 3rd party fails to comply with LOHT’s privacy policy terms, LOHT is not liable for such failure.

• To respond to subpoenas, court orders, or legal process.

• To establish or exercise legal rights or defend against legal claims.

• To the extent LOHT believes it necessary to report situations involving physical harm or potential threats of physical harm to any person, including suspected neglect or abuse of any child or elder.

• To the extent LOHT or its assets are acquired by or merged with another company.

 
Security
LOHT cannot guarantee that unauthorized personnel will not gain access to Personal Information. In using the Service, your information will travel through 3rd party infrastructures which are not under LOHT’s control (such as a 3rd party SMS delivery platform or your carrier network). We cannot protect, nor does this Policy apply to, any information that you transmit to other users. You understand that anyone with access to your mobile phone may be able to view messages sent/received using the Service, and you agree that LOHT is not liable to you if this occurs.
 
Message/Data Rates
Message and data rates may apply for any messages sent between you and LOHT. LOHT is not liable for the cost of any such messages. If you have any questions about your text or data plan, it is best to contact your wireless provider.
 
Opting Out
You can opt out of the Service at any time and for any reason by replying “STOP” to any text message from LOHT.
 
Children
The Service is not intended for children under 13 years of age. LOHT does not knowingly collect information from children under the age of 13. Children aged 13 or older should not submit Personal Information without the permission of their parents or guardians. By using the Service, you are representing that you are at least 18 years of age, or that you are at least 13 years of age and have your parent’s permission to use the Service.
 
Intended Audience
LOHT requires that users of this service be limited to US residents only.
